These Terms & Conditions (“Terms”) govern your access to and use of this website and any products, services, and digital content sold or provided by Resilience Birthright Inc. / Resilience Birthright Productions (“Resilience Birthright,” “we,” “us,” or “our”). By accessing the site, downloading content, or purchasing any product, you agree to these Terms.

1) Intellectual Property Ownership

All content on this website and in our products is owned by or licensed to Resilience Birthright and is protected by copyright, trademark, and other intellectual property laws.

This includes, without limitation:

  • All books, graphic novels, audiobooks, scripts, lesson plans, curricula, worksheets, assessments, slides, videos, animations, and multimedia content
  • All characters, storylines, settings, artwork, illustrations, logos, design elements, and brand assets (including but not limited to Res, Lil Jess/Res, Terry the Apple Tree, Sunny the Squirrel, and all related universe elements)
  • All educational frameworks, activities, vocabulary sets, games, bingo boards, flashcards, and original text/visual content
  • All website content, copy, downloads, and resource files

You may not use our intellectual property except as expressly allowed in the license granted below.

2) Purchases Are a License to Use, Not a Transfer of Ownership

When you purchase or download any Resilience Birthright product (digital or physical), you are purchasing a limited license to use the content—not ownership of the content or any intellectual property rights.

All rights not expressly granted to you are reserved by Resilience Birthright.

3) License Grant (Permitted Use)

Unless otherwise stated at the time of purchase, Resilience Birthright grants you a non-exclusive, non-transferable, revocable, limited license to use the purchased materials as follows:

For Individual Purchasers (personal use):

  • You may download and use the materials for your own personal learning or household use.
  • You may print copies for use within your household/family learning environment.

For Educators/Classrooms/Schools:

  • You may use the materials with your own students in your classroom or educational setting.
  • You may print copies for students within your classroom (or the specific program/site covered by your purchase).
  • You may display materials in your classroom (e.g., on a projector/Smartboard) for instructional purposes.

Important: If your purchase is labeled as a “Single Teacher License,” “School License,” “District License,” or similar, the permitted use is limited to the license type described on the product page or checkout.

4) Prohibited Uses (No Sharing, Reselling, or Replication)

You may not, under any circumstances:

  • Copy, reproduce, modify, adapt, translate, or create derivative works from our materials (except minor edits for your own internal classroom use, such as adding a name/date line)
  • Share, email, upload, post, or distribute the materials to others, including colleagues, other classrooms, or other schools, unless you have purchased an appropriate multi-user license
  • Upload materials to shared drives, learning management systems, or public/private repositories (e.g., Google Drive links shared outside your licensed group, Dropbox, Schoology, Canvas, Blackboard, etc.) unless access is restricted solely to the licensed users and explicitly permitted by the license type
  • Resell, sublicense, rent, lease, or commercially exploit any content
  • Remove copyright notices, logos, watermarks, attributions, or proprietary markings
  • Use our characters, artwork, storylines, or brand assets to create new products, merchandise, or promotional materials without written permission
  • Use any portion of our content to train AI models, create datasets, or generate derivative content using AI tools for distribution or sale

Sharing is the most common violation. If multiple teachers, classrooms, or sites want to use the same materials, please purchase the correct license or contact us for a custom license. Please contact us if our pricing is a barrier we have grant opportunities through our nonprofit to provide books and services for free or at a discounted rate.

5) Digital Products and Downloads

All digital sales are considered delivered upon purchase and/or download. Unless otherwise required by law, digital products are typically non-refundable once accessed or downloaded. If you experience an issue accessing your purchase, contact us and we’ll help resolve it.

6) User Conduct

You agree not to misuse the site or content, including attempting to bypass access controls, download limits, paywalls, or license restrictions, or engaging in any behavior that violates applicable law.

7) Enforcement, Violations, and Termination

We reserve the right to investigate suspected violations of these Terms. If we determine that you have violated these Terms or exceeded the scope of your license, we may:

  • Terminate or suspend your access to the materials
  • Revoke the license granted to you
  • Refuse future sales
  • Pursue legal remedies, including claims for damages and injunctive relief, where appropriate

8) Third-Party Links and Tools

This website may include links to third-party resources (e.g., videos, educational tools). We are not responsible for third-party content, policies, or practices.

9) Disclaimer

Our materials are provided for educational purposes. While we aim for accuracy and high-quality instruction, we do not guarantee specific outcomes. You are responsible for how you implement the materials in your setting.

10) Safety, Supervision, and Assumption of Risk

Our educational materials may include hands-on activities, outdoor learning, community engagement, service projects, waste audits, litter pickups, and/or outreach or advocacy suggestions (collectively, “Activities”). All Activities must be supervised and approved by a responsible adult. Minors should never participate in Activities without appropriate adult supervision and adherence to all school, district, and local safety policies.

You acknowledge and agree that:

  • You are solely responsible for determining whether an Activity is appropriate for your students/participants and setting, and for providing proper supervision, safety precautions, and accommodations.
  • You are solely responsible for complying with all applicable laws, school/district requirements, parental permission policies, and safety procedures (including, where applicable, PPE such as gloves, proper hygiene, and safe handling/disposal practices).
  • Any outreach, communications, campaigns, or calls-to-action (including contacting school staff, administrators, community partners, or public agencies) must be conducted only with adult oversight and in accordance with your organization’s communication policies.

To the fullest extent permitted by law, Resilience Birthright Inc. / Resilience Birthright Productions disclaims liability for any injuries, incidents, losses, claims, or damages arising from or related to participation in Activities, including but not limited to outdoor work, handling waste/materials, tool use, or community outreach. Participation in Activities is voluntary and undertaken at your own risk.

11) Limitation of Liability

To the maximum extent permitted by law, Resilience Birthright will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or materials.

12) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will reflect the most recent version. Continued use of the site after updates constitutes acceptance of the updated Terms.

13) Store, Shipping, and No-Refund Policy

A) All Sales Are Final

All purchases are final sale. We do not offer returns, exchanges, or refunds.

B) Digital Products (Downloads)

  • Digital products (including lesson plans, worksheets, cards, videos, and other downloadable resources) are delivered electronically via download link and/or email access.
  • Digital purchases are considered delivered once the download link is provided or the file is accessed.
  • Digital products are non-refundable once delivered or accessed, except where required by law. If you experience a technical issue accessing your files, contact us at ResilienceBirthright@gmail.com and we will help resolve the issue.

C) Physical Products (Books, Printed Materials, Merchandise)

  • Physical orders are processed within 7-10 business days unless otherwise noted on the product page.
  • Shipping times vary by destination and carrier. Delivery dates are estimates and are not guaranteed.
  • You are responsible for providing an accurate shipping address. If an order is returned due to an incorrect or incomplete address, additional shipping fees may apply to reship the order.
  • Physical orders are processed within the timeframe shown on the product page and shipped to the address provided at checkout.
  • All physical product sales are final and are not eligible for return, exchange, or refund.

D) Shipping Rates, Tracking, and International Orders

  • Shipping rates are calculated at checkout (or listed on the product page).
  • Tracking is provided when available and may be sent by email once your order ships.
  • For international orders: customers are responsible for any customs fees, duties, taxes, or import charges assessed by their country.
  • You are responsible for entering a correct and complete shipping address. We are not responsible for orders delivered to an incorrect address provided by the customer.

E) Lost, Delayed, or Damaged Shipments

  • If your package is delayed, lost, or marked delivered but not received, please contact us at ResilienceBirthright@gmail.com within 3 days of the expected delivery date so we can assist with next steps.
  • While we do not offer refunds or returns, if a physical order arrives damaged, defective, or incorrect, please email ResilienceBirthright@gmail.com within 7 days of delivery and include:

Your order number
Photos of the item(s) and packaging
A brief description of the issue

We will review and, where appropriate, provide a resolution such as a replacement shipment or other support at our discretion.

F) Cancellations and Order Changes

  • If you need to cancel or change an order, contact us as soon as possible at ResilienceBirthright@gmail.com.
  • Orders that have already shipped cannot be canceled. Digital orders cannot be canceled once delivered.

G) Lost, Delayed, or Missing Shipments

Carrier delays may occur and delivery dates are not guaranteed. If tracking shows “delivered” but you have not received your package, please contact the carrier first and then notify us at ResilienceBirthright@gmail.com within 3 days of the delivery scan so we can assist with next steps.
